Points of Clarification

Para 10.57 – Flood Risk and Drainage

It has been confirmed that a small portion of the site to the north-east lies within Flood Zone 2.  Flood Zone 2 normally requires a Sequential test as dwellings are classed as “More Vulnerable” development, however an Exception test is not required.  The land within Flood Zone 2 primarily affects the Public Right of Way and where it overlaps into the site the indicative layout shows that the area to laid to landscaping and road.  NPPF paragraph 175 states that a sequential test is not required where it can be demonstrated that no built development, including access or escape routes, land raising or other potentially vulnerable elements, would be located on an area that would be at risk of flooding from any source, now and in the future.  It is considered that this is shown on the indicative layout and it is recommended that an informative be added to ensure that this area is kept free from built development at Reserved Matters. 

Para 10.69 Loss of Agricultural Land

It has been clarified that the application site is Grade 3 land, not Grade 2 as stated in the report.  Grade 3 is also Best Most Versatile Land, and this was considered when the site was identified as a draft allocation in the Regulation 19 version of the emerging Selby Local Plan.  The area surrounding Brayton is all grade 3 land, this includes the housing site allowed at appeal on Barff Lane as well as draft allocation BRAY-X on Mill Lane to the south.  There are no sites with a lower agricultural land grade around Brayton that could accommodate the development proposed.
